An Act respecting a national day of commemoration of the exodus of Vietnamese refugees and their acceptance in Canada after the fall of Saigon and the end of the Vietnam War.

Một Đạo luật bày tỏ sự trân trọng một ngày quốc lễ để ghi nhớ việc di cư của người tỵ nạn Việt Nam và sự chọn lựa đến định cư tại Canada sau khi thất thủ Sài Gòn [nt. sụp đổ] và chấm dứt chiến tranh Việt Nam.

TÓM TẮT

This enactment designates the thirtieth day of April in each and every year as “Journey to Freedom Day”.

Việc ban hành đạo luật này xác định rằng ngày thứ Ba mươi của tháng 4 hàng năm sẽ được coi là “Ngày Hành Trình Tìm Tự Do”.

Whereas the Canadian Forces were involved in the Vietnam War with supervisory operations to support the aim of establishing peace and ending the Vietnam War by assisting in the enforcement of the Paris Peace Accords of 1973;

Xét rằng Quân đội Canada đã liên quan đến chiến tranh Việt Nam bằng hoạt động giám sát để hỗ trợ mục đích thiết lập hòa bình và chấm dứt chiến tranh Việt Nam bằng cách tham gia vào lực lượng thực thi Hiệp định Hòa bình Paris 1973;

Whereas on April 30, 1975, despite the Paris Peace Accords, the military forces of the People’s Army of Vietnam and the National Liberation Front invaded South Vietnam, which led to the fall of Saigon, the end of the Vietnam War and the establishment of the Socialist Republic of Vietnam Government;

Xét rằng vào ngày 30 tháng 4 năm 1975, mặc dù đã ký kết Hiệp định Hòa bình Paris nhưng Quân đội Nhân dân Việt Nam và Mặt trận Giải phóng Miền Nam Việt Nam đã xâm lược Miền Nam và dẫn đến việc thất thủ Sài Gòn, chấm dứt chiến tranh Việt Nam và thiết lập chính phủ Cộng hoà Xã hội Chủ nghĩa Việt Nam;

Whereas the United Nations High Commissioner for Refugees has reported that these events and the conditions faced by individuals in Vietnam, including deteriorating living conditions and human rights abuses, contributed to the exodus of approximately 840,000 Vietnamese people, who were referred to at the time as “Vietnamese boat people”, to neighbouring countries in the ensuing years;

Xét rằng Cao Ủy Tỵ Nạn Liên Hiệp Quốc đã phúc trình rằng những biến cố này và những hoàn cảnh mà người Việt Nam phải đối diện bao gồm điều kiện sống ngày càng tồi tệ và nhân quyền bị xâm phạm, đã gây ra cuộc di cư của khoảng 840,000 người Việt nam, những người vào thời gian đó được gọi là “thuyền nhân Việt Nam” vượt thoát đến các quốc gia láng giềng vào những năm sau đó;

Whereas the United Nations High Commissioner for Refugees has reported that at least 250,000 Vietnamese people lost their lives at sea during the exodus of the Vietnamese people for reasons that included drowning, illness, starvation and violence from kidnapping or piracy;

Xét rằng Cao Ủy Tỵ Nạn Liên Hiệp Quốc đã phúc trình rằng có ít nhất 250,000 người Việt Nam đã bỏ mạng trên biển trong cuộc di cư của người Việt Nam vì những lý do bao gồm chết đuối, đau ốm, đói khát, và bạo lực từ việc bị bắt cóc hay cướp biển [nd. hãm hiếp];

Whereas the sponsorship refugee program in Canada, assisted by the efforts of Canadian families, Canadian charities, religious groups and non-governmental organizations, contributed to Canada accepting more than 60,000 Vietnamese refugees, among whom it has been estimated that 34,000 were privately sponsored and 26,000 were assisted by the Canadian government;

Xét rằng chương trình bảo lãnh người tỵ nạn ở Canada, được hỗ trợ với những nỗ lực của các gia đình người Canada, của các hội từ thiện Canada, của các nhóm tôn giáo và các tổ chức phi chính phủ, đã đóng góp vào việc Canada đón nhận hơn 60,000 người tỵ nạn trong số đó ước tính có đến 34,000 người được bảo lãnh bởi các tổ chức tư nhân, và 26,000 người được bảo lãnh bởi chính phủ Canada;

Whereas the major and sustained contribution by the people of Canada to the cause of refugees was recognized by the United Nations High Commissioner for Refugees when it awarded the Nansen Refugee Award to the “People of Canada” in 1986; And whereas April 30 is referred to by many members of the community of displaced Vietnamese people and their families in Canada as “Black April Day”, or alternatively as “Journey to Freedom Day”, and is, therefore, an appropriate day to designate as a day to remember and commemorate the lives lost and the suffering experienced during the exodus of Vietnamese people, the acceptance of Vietnamese refugees in Canada, the gratitude of Vietnamese people to the Canadian people and the Government of Canada for accepting them, and the contributions of Vietnamese-Canadian people - whose population is now approximately 300,000 - to Canadian society;

Xét rằng phần lớn và sự đều đặn đóng góp có được là từ người dân Canada vì lý do tỵ nạn được công nhận bởi Cao Ủy Tỵ Nạn Liên Hiệp Quốc khi Cao Ủy trao Giải “Nansen Refugee Award” cho “Dân chúng Canada” vào năm 1986; Và xét rằng ngày 30 tháng 4 được nhiều thành viên trong cộng đồng tỵ nạn và gia đình của họ tại Canada nhắc đến như “Ngày Tháng Tư Đen”, hay “Ngày Hành Trình Tìm Tự Do”, và vì thế, là ngày chính đáng để trở thành ngày ghi lại và tưởng nhớ những người đã khuất cũng như những kinh nghiệm đau thương mà người Việt tỵ nạn phải trải qua, và sự đón nhận người Việt tỵ nạn tại Canada, sự tri ân của người Việt đối với người Canada và chính phủ Canada đã tiếp nhận họ, và sự đóng góp của người Canada gốc Việt – con số đến nay là khoảng 300,000 người – vào xã hội Canada;

Now, therefore, Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows

Vì thế, Nữ hoàng, căn cứ bởi và cùng với sự cố vấn và đồng thuận của Thượng viện và Hạ viện Canada, nay ban hành đạo luật như sau:

SHORT TITLE

TỰA NGẮN GỌN

1. This Act may be cited as the Journey to Freedom Day Act: JOURNEY TO FREEDOM DAY.
1. Đạo luật này được gọi là Đạo luật Ngày Hành Trình Tìm Tự Do: NGÀY HÀNH TRÌNH TÌM TỰ DO.

2. Throughout Canada, in each and every year, the thirtieth day of April shall be known as “Journey to Freedom Day”.
2. Khắp đất nước Canada, hàng năm và mỗi năm, vào ngày thứ ba mươi của tháng Tư sẽ được biết đến như là “Ngày Hành Trình Tìm Tự Do”.

3. For greater certainty, Journey to Freedom Day is not a legal holiday or a non-juridical day.
3. Để rõ nghĩa hơn, Ngày Hành Trình Tìm Tự Do sẽ là ngày lễ kỷ niệm nhưng không phải là ngày nghỉ lễ chính thức.
